1. Introduction

1.1. These Terms and Conditions ("Terms") constitute a legally binding agreement between Tumble Mania, operated by Michelle Haasbroek t/a (hereinafter referred to as "TM"), and the parent/legal guardian of the participant or the participant if 21 years and older, responsible for payment (hereinafter referred to as "The Responsible Person"), who registers the participant (hereinafter referred to as "The Attendee"), for enrolment in the Annual TM Regular Class Program.

 

2. Class Fee Rates and Payment Options

2.1. Annual TM member registration fee is payable once a year before the attendance of the 1st regular class and thereafter at the start of each year.

2.2. Tuition is calculated and invoiced per term, for 4 terms.

2.3. Term fees are to be paid in full at the beginning of each term or via TM debit order system, allowing The Responsible Person to pay the term fee in 3 equal payments in advance on the 1st of every month.

2.5. No classes are conducted during School Holidays and Public Holidays, except for specified dates during June School Holidays.

2.6. Tuition fees exclude additional fees such as Star booklet, Attire, Competitions, Events, Camps, GSA registration fees, and legal fees.

2.7. TM reserves the right to adjust registration, entry, evaluation, and class fees, with reasonable notice provided to The Responsible Person.

 

3. Cancellation of Classes

3.1. Cancellation must be made 20 workdays before the beginning of the new term.

3.2. The member is liable for fees until written cancellation is received by TM via email at admin@tumblemania.co.za.

3.3. Non-payment due to cancellation of debit order or non-attendance does not automatically cancel the enrollment agreement.

3.4. Failure to cancel by 1 December automatically enrols The Attendee for the following year, subject to applicable charges and fee adjustments.

3.5. Parents are urged to adhere to the cancellation policy to avoid unnecessary losses for TM.

 

4. Classes

4.1. Classes include gymnastics skill training, body conditioning, flexibility, fitness training, official TM gear orders, evaluation reports/awards, and participation in events.

4.2. Classes are conducted in person at selected TM venues, subject to government regulations.

4.3. Class schedules may be adjusted or cancelled by TM with reasonable notice provided.

4.4. TM reserves the right to refuse any applicant and requires The Responsible Person to ensure the physical, medical, and mental fitness of The Attendee for participation.

 

5. General

5.1. Spectators are not allowed on the training area, and pets are prohibited on TM premises.

5.2. The Responsible Person and The Attendee are bound by TM notices, rules, regulations, policies, and procedures.

 

6. Use of Personal Images

6.1. By participating in Tumble Mania gymnastics classes or events, you acknowledge and agree that we may capture and use photographs or videos of participants for business purposes, including but not limited to promotional materials, social media posts, and website content.

6.2. We may use these images to showcase the activities, achievements, and experiences of our participants and to promote the Tumble Mania brand.

6.3. If you do not wish for your image to be used for these purposes, please inform us in writing at admin@tumblemania.co.za, and we will make reasonable efforts to accommodate your request.

6.4. Tumble Mania will not use personal images in a manner that is misleading, offensive, or inappropriate, and we will respect the privacy and dignity of all individuals depicted in our promotional materials.

6.5. By attending our classes or events, you grant Tumble Mania the perpetual, worldwide, royalty-free licence to use your likeness in promotional materials, as described in this section.

 

7. Protection of Personal Information

7.1. TM complies with the Protection of Personal Information Act (POPIA) and is committed to protecting the privacy and confidentiality of personal information collected during enrollment and participation in TM activities.

7.2. Personal information collected, including but not limited to names, contact details, and medical information, is used for administrative and communication purposes related to TM activities only.

7.3. TM will not disclose or share personal information with third parties unless required by law or with explicit consent from The Responsible Person.

7.4. The Responsible Person has the right to access, correct, or delete personal information held by TM by contacting admin@tumblemania.co.za.

8. Waiver

8.1. TM, its management, staff, agents, and representatives are indemnified against any liability relating to accidents, injuries, illnesses, or damages sustained by The Responsible Person or The Attendee during TM activities.

 

9. Submission

9.1. By submitting the online registration form, The Responsible Person binds themselves to these Terms and Conditions.
