IMPORTANT NOTICE — SECTION 49, CONSUMER PROTECTION ACT 68 OF 2008
This document contains clauses that:
* LIMIT the legal liability of Tumble Mania Pty Ltd
* CONSTITUTE an assumption of risk by the Responsible Person on behalf of the Attendee
* IMPOSE financial and legal obligations on the Responsible Person
Please read this document carefully before booking and accepting.

This Private Class Booking, Waiver & Indemnity ("Waiver") governs the booking, payment, participation, and all associated risk and liability for private and semi-private coaching sessions offered by Tumble Mania Pty Ltd ("Tumble Mania"). It is binding on the parent, legal guardian, or adult responsible for the participant ("Responsible Person"). This Waiver applies to all persons attending a private session, whether or not they are existing Tumble Mania members.
1. PRIVATE CLASS BOOKING & PAYMENT
1.1 Private and semi-private coaching sessions must be booked and paid in full in advance via the Tumble Mania booking platform before the session is confirmed.
1.2 A booking is only confirmed once full payment has been received and processed. Tumble Mania reserves the right to decline or reschedule any booking at its discretion.
1.3 Private session fees are set by Tumble Mania and are subject to change. The fee applicable at the time of booking will be confirmed during the booking process.
1.4 Private sessions are charged per session. No subscription or recurring billing applies unless separately agreed in writing with Tumble Mania.
2. CANCELLATION, NO-SHOW & REFUND POLICY
CANCELLATION & NO-SHOW POLICY
This policy applies to ALL private and semi-private sessions booked with Tumble Mania.
By completing your booking, you accept this policy unconditionally.
Cancellations made MORE than 72 hours before the scheduled session:
A full account credit will be issued for rebooking purposes.
No cash refund will be provided.
Cancellations made WITHIN 72 hours of the scheduled session:
The full session fee is forfeited.
No refund, credit, or transfer to another session will be issued.
No-shows (failure to attend without any prior notice):
The full session fee is forfeited.
No refund, credit, or transfer to another session will be issued.
Late arrivals:
The session will end at the originally scheduled time regardless of late arrival.
No fee adjustment or credit will be made for time lost due to late arrival.
2.1 If Tumble Mania cancels a session due to coach unavailability or unforeseen circumstances, the Responsible Person will be offered a full reschedule at a mutually convenient time or a full account credit. No cash refund will be issued unless rescheduling is not possible within thirty (30) days.
2.2 Account credits issued under this clause have no cash value, are non-transferable, and must be used within six (6) months of the date of issue.
2.3 Tumble Mania bears no liability for any loss suffered by the Responsible Person as a result of a cancelled or rescheduled session, beyond the credit or reschedule provided under clause 2.1.
3. GUARDIAN CAPACITY
3.1 The Responsible Person declares that:

They are the biological parent, legal guardian, or duly authorised adult caregiver of the Attendee, or the Attendee themselves if 18 years of age or older;

They have full legal capacity to enter into this Waiver and to bind the Attendee to its terms;

All information provided during booking is accurate and complete;

They have read and understood this entire Waiver before accepting.
3.2 Where the Attendee is 18 years of age or older and booking on their own behalf, references to the Responsible Person shall be read as referring to the Attendee themselves.
3.3 Digital acceptance of this Waiver constitutes a valid and binding electronic signature under the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
4. DESCRIPTION OF ACTIVITIES
4.1 Private and semi-private coaching sessions at Tumble Mania may include any combination of the following:

Tumbling and acrobatic skill development
-
Artistic gymnastics coaching
-
Trampoline training
-
Body conditioning, flexibility, and fitness training

Technique correction and personalised coaching
4.2 The content of each session is determined by the coach in consultation with the Responsible Person and the Attendee's goals and current ability level.
4.3 Tumble Mania coaches are entitled to modify session content at any time based on the Attendee's fitness, safety, or progress.
5. ASSUMPTION OF RISK
RISK NOTICE — Section 49, Consumer Protection Act 68 of 2008
Gymnastics and tumbling activities carry INHERENT RISKS of physical injury, including but not limited to:
* Sprains, strains, and muscle injuries
* Fractures and broken bones
* Joint injuries including dislocations
* Head, neck, and spinal injuries (including in rare cases, permanent disability)
* Bruising, lacerations, and soft-tissue injuries
* Injuries caused by contact with equipment, floors, or other participants
* Injuries arising from the Attendee's own actions or the actions of others
These risks exist even when all reasonable safety precautions are taken by Tumble Mania
and its coaches. By accepting this Waiver, the Responsible Person voluntarily acknowledges
these risks and consents to the Attendee's participation with full knowledge of them.
5.1 The Responsible Person confirms that the Attendee is, to the best of their knowledge, physically fit and capable of participating in gymnastics-based activities at the time of the session.
5.2 The Responsible Person accepts that coaches and staff may make physical contact with the Attendee as part of normal spotting, coaching, and safety supervision techniques.
5.3 The Responsible Person accepts that the Attendee participates at their own risk and that Tumble Mania's coaches will exercise reasonable professional skill and care during the session.
6. MEDICAL CONDITIONS & EMERGENCY AUTHORITY
6.1 Disclosure Obligation
6.1.1 The Responsible Person must disclose, before the session commences, any medical conditions, physical limitations, allergies, previous injuries, or any other health concerns that may affect the Attendee's safe participation in the session. Disclosures should be communicated to the coach directly before the session begins or emailed to admin@tumblemania.co.za in advance.
6.1.2 Failure to disclose a relevant medical condition that subsequently contributes to injury releases Tumble Mania from any liability arising from that non-disclosure.
6.1.3 Tumble Mania reserves the right to refuse or modify a session if the Attendee's disclosed medical condition poses a safety risk, at the coach's sole discretion.
6.2 Emergency Medical Authority
6.2.1 Where the Responsible Person cannot be reached in a medical emergency during the session, the Responsible Person hereby authorises Tumble Mania's staff to: call emergency medical services; consent to emergency medical treatment or transport to the nearest appropriate medical facility; and act in the Attendee's best interests until the Responsible Person can be reached.
6.2.2 All costs associated with emergency medical treatment, ambulance services, or hospitalisation are for the sole account of the Responsible Person. Tumble Mania bears no financial liability for such costs.
6.2.3 Tumble Mania will make all reasonable efforts to contact the Responsible Person as soon as possible in the event of a medical incident.
7. INDEMNITY & LIMITATION OF LIABILITY
INDEMNITY NOTICE — Section 49, Consumer Protection Act 68 of 2008
The clauses below limit the liability of Tumble Mania and impose obligations on the
Responsible Person. Please read clauses 7.1 to 7.5 with particular care.
7.1 Subject to clause 7.2, Tumble Mania, its directors, employees, coaches, contractors, and agents shall not be liable for any injury, loss, damage, death, or expense suffered by the Attendee or any third party arising from participation in any private session, including injuries resulting from: the Attendee's own conduct, actions, or failure to follow instructions; the conduct of other persons; equipment condition where reasonable maintenance steps were taken; or the inherent risks of gymnastics described in clause 5.
7.2 Nothing in this Waiver excludes Tumble Mania's liability for death or personal injury caused by gross negligence or wilful misconduct, or any liability that cannot be excluded under the Consumer Protection Act 68 of 2008 or other applicable South African law.
7.3 The Responsible Person fully and irrevocably indemnifies and holds harmless Tumble Mania, its directors, employees, coaches, contractors, and agents against all claims, demands, damages, costs, losses, and expenses (including legal fees on the attorney-and-client scale) arising from: the Attendee's participation in any private session; the Attendee's conduct causing injury or damage to any third party or Tumble Mania property; any breach of this Waiver; or any undisclosed medical condition.
7.4 The Responsible Person further indemnifies Tumble Mania's individual coaches and staff members personally from any claims arising from coaching or supervision conducted in the ordinary course of their duties during the session.
7.5 The Responsible Person accepts liability for any damage to Tumble Mania property or equipment caused by the Attendee during the session, whether accidental or deliberate, and agrees to reimburse Tumble Mania for the reasonable cost of repair or replacement.
8. CONDUCT
8.1 The Attendee and all accompanying persons are expected to behave respectfully toward coaches, staff, and other persons on Tumble Mania premises at all times.
8.2 The Responsible Person may observe the session from a designated spectator area if available. Coaching or instructing the Attendee during the session is not permitted — this is the exclusive role of the Tumble Mania coach.
8.3 Tumble Mania reserves the right to end a session immediately and without refund if the Attendee or any accompanying person behaves in a manner that is disruptive, disrespectful, or poses a safety risk.
9. MEDIA CONSENT
9.1 By accepting this Waiver, the Responsible Person consents to Tumble Mania capturing and using photographs and videos of the Attendee taken during the private session for social media, digital marketing, the Tumble Mania website, and internal coaching review.
9.2 To opt out of media use, the Responsible Person must notify Tumble Mania in writing at admin@tumblemania.co.za before the session takes place.
10. PRIVACY & POPIA
10.1 Personal information collected in connection with the private session booking (including contact details, payment information, and medical information) is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and used solely for the administration of the booking and session. It will not be shared with third parties except where required by law or with payment processors. The Responsible Person may contact admin@tumblemania.co.za to access, correct, or delete their information.
11. DIGITAL ACCEPTANCE & ECTA
11.1 The Responsible Person's digital acceptance of this Waiver constitutes a valid and binding electronic signature in terms of the Electronic Communications and Transactions Act 25 of 2002 (ECTA). A digital record of acceptance, including the timestamp and document version, will be retained by Tumble Mania.
12. GENERAL
12.1 If any provision of this Waiver is found invalid or unenforceable, the remaining provisions continue in full force.
12.2 This Waiver is governed by the laws of the Republic of South Africa. Any disputes shall first be raised with Tumble Mania at admin@tumblemania.co.za, allowing ten (10) business days for a response, before any further action is taken.
12.3 This Waiver applies to private and semi-private sessions only and does not constitute membership. Full club membership is subject to the Tumble Mania Membership & Participation Agreement.
